1. Scope

These General Terms and Conditions apply to all orders placed by consumers through the online shop of BIOL-Europe GmbH.

A consumer within the meaning of these terms is any natural person who concludes a legal transaction for private purposes.

3. Offer and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalogue.

By clicking the order button, the customer places a binding order for the goods in the shopping cart.

The purchase contract is only concluded when we expressly confirm the order or ship the goods.

We reserve the right to reject or cancel orders, in particular in cases of:

  • obvious pricing errors,

  • technical errors,

  • unavailability of goods,

  • suspicion of misuse or fraud.

4. Prices and Shipping Costs

All prices shown include the applicable statutory VAT.

In addition to the prices shown, shipping costs may apply. Shipping costs are displayed to the customer during the ordering process.

5. Payment Methods

The following payment methods are available:

  • Shopify Payments

  • PayPal

  • Prepayment (bank transfer)

  • Purchase on invoice (where available)

  • Klarna (instalment payment, instant bank transfer, invoice)

If prepayment is selected, dispatch will only take place after payment has been received.

If you select Klarna as your payment method, your personal data will be transmitted to Klarna Bank AB, Sveavägen 46, 111 34 Stockholm, Sweden. Processing is carried out for the purpose of payment processing and credit assessment. For more information, please refer to the Klarna Privacy Policy.

6. Delivery and Shipping

Delivery is made within Germany and to selected countries of the European Union.

Estimated delivery times are shown during the ordering process.

If a product is temporarily unavailable, we will inform the customer immediately.

Partial deliveries are reserved insofar as this is reasonable for the customer.

7. Retention of Title

The goods remain our property until full payment has been made.

8. Right of Withdrawal

Consumers are entitled to the statutory right of withdrawal. Further information on the right of withdrawal can be found on our "Right of Withdrawal" page.

9. Warranty

The statutory warranty rights apply.

10. Liability

We are liable in accordance with statutory provisions for intent and gross negligence, as well as for damages arising from injury to life, body or health caused by a breach of our obligations.

We accept no liability for damages caused by improper use, incorrect handling, normal wear and tear, or independent use of the products.

In cases of slightly negligent breach of material contractual obligations, liability is limited to the foreseeable, contract-typical damage.

Further liability is excluded to the extent permitted by law.

11. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR):

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, insofar as this does not restrict mandatory statutory consumer protection provisions.
